Terms and Conditions of the POZA Online Store

I. General provisions

The owner of the online store available at www.poza.pl (“Online Store”, “Store”) is:

Definitions:

  • Store – the POZA online store available at www.poza.pl.
  • Customer – a natural person with full legal capacity, as well as a legal person or an organizational unit without legal personality to which legal capacity is granted by law, using the Store.
  • Consumer – a Customer who is a consumer within the meaning of the provisions of the Polish Civil Code.
  • Entrepreneur with consumer rights – a natural person conducting sole proprietorship business activity, entered in the Polish CEIDG register, who concludes an agreement with the Store directly related to their business activity, but not of a professional nature for that person, resulting in particular from the subject of the activity performed. Such a person is entitled to consumer rights in the scope of withdrawal from the agreement, protection against unfair contract terms and provisions concerning the non-conformity of goods with the agreement.
  • Terms and Conditions – these terms and conditions of the Online Store.
  • Order – a declaration of intent by the Customer aimed directly at concluding a Sales Agreement with POZA, submitted via the form on the Store website, by e-mail or by telephone.
  • Account – an electronically provided service under which the Customer’s data, Order history and the list of products added to the “Wishlist” are stored.
  • Wishlist – a Store function enabling the Customer to create a list of products in which they are interested.
  • Registration form – a form available in the Store, used to create an Account.
  • Cart – an element of the Store software enabling Products intended for purchase to be added and an Order to be placed.
  • Product – a movable item available in the Store that may be the subject of a Sales Agreement.
  • Sales Agreement – an agreement for the sale of a Product concluded between the Customer and POZA through the Online Store.
  • Newsletter – a service consisting in sending commercial information to the e-mail address provided, in particular information about products, promotions and new POZA collections.

These Terms and Conditions define the rules for using the Store and are addressed to all Customers. By using the Store, creating an Account or placing an Order, the Customer accepts the provisions of these Terms and Conditions.

The provisions of the Terms and Conditions concerning the Consumer apply accordingly to the Entrepreneur with consumer rights, unless a given provision expressly concerns only the Consumer.

The provisions of these Terms and Conditions are not intended to exclude or limit any Consumer rights arising from mandatory provisions of law. In the event of a conflict between the provisions of the Terms and Conditions and such legal provisions, the legal provisions shall prevail.

The Store applies appropriate technical and organizational measures to protect Customers’ personal data in accordance with the Privacy Policy.

Before placing an Order, the Customer has the opportunity to read the Privacy Policy and cookies information. The Privacy Policy is informative in nature and sets out the rules for processing personal data and using cookies.

II. Product descriptions and prices

  • Products offered in the Store are new and free from legal defects, unless the Product description expressly states otherwise.
  • Products are described in detail – the website contains information about the Product’s features, price, available sizes and other essential parameters.
  • Information about Products presented in the Store, in particular descriptions and prices, does not constitute an offer within the meaning of Article 66 of the Polish Civil Code, but an invitation to conclude an agreement within the meaning of Article 71 of the Polish Civil Code.
  • Product photos are illustrative. The shade of the material may differ slightly from the actual appearance due to the Customer’s screen settings.
  • The binding and final price is the Product price indicated on the Store website at the time of placing the Order. All prices are given in euro (EUR) and include VAT.
  • The prices indicated do not include delivery costs, except for free delivery within Poland – see section VII. The final amount payable includes the Product price and any delivery costs visible in the Cart.
  • In the event of a Product price reduction, the Store also indicates, next to the new price, the lowest price of that Product applicable during the 30 days before the price reduction was introduced. If the Product has been offered in the Store for less than 30 days, the lowest price from the period between the date the Product was introduced into the offer and the date the price reduction was introduced is indicated.
  • POZA reserves the right to change prices, organize promotions and sales, and cancel or modify them. Changes do not apply to Orders placed before such changes are introduced.

III. Customer obligations

  • The Customer is obliged to use the Store in accordance with the law, these Terms and Conditions and good practices.
  • The Customer may not provide unlawful content.
  • The Customer is obliged to use the Store in a way that does not interfere with its operation, in particular by refraining from actions that interfere with the Store’s software, technical infrastructure and security measures.

IV. Contact point and user content (DSA)

  • POZA designates the e-mail address sklep@poza.pl as the contact point for communication regarding the operation of the Store, including matters concerning content published or transmitted through the Store, in accordance with Regulation (EU) 2022/2065 on a Single Market for Digital Services (DSA).
  • The Customer may not publish or transmit through the Store any content that is unlawful, infringes the rights of third parties, violates good practices or breaches these Terms and Conditions.
  • POZA may remove or block content that violates the law or these Terms and Conditions and, where necessary, restrict access to the Account. Such a decision is made after an individual assessment of each case.
  • The Customer may appeal against a decision to remove content or restrict access to the Account by contacting POZA at sklep@poza.pl. The appeal should include a description of the matter and justification. POZA will review the appeal without undue delay.

V. Account

  • To register an Account, the Customer completes the Registration form, providing at least their first name, surname and e-mail address.
  • Other data, such as delivery address and invoice details, including a tax identification number if applicable, are completed by the Customer no later than at the Order placement stage.
  • Creating an Account is free of charge.
  • Logging into the Account takes place by entering the e-mail address and password set by the Customer.
  • After registration, the Customer receives an e-mail confirming creation of the Account. Upon receiving it, an agreement for the provision of the Account service for an indefinite period is concluded.
  • The Customer may request deletion of the Account at any time by sending a request to sklep@poza.pl or by contacting the Store by telephone. POZA may verify the Customer’s identity.
  • POZA may terminate the agreement for the provision of the Account service with immediate effect if:
    • the Customer grossly violates the provisions of the Terms and Conditions or the law,
    • the Customer’s actions threaten the security of the Store system or other users.
    In such a case, the Account may be blocked and access to it may be prevented.
  • Deletion of the Account does not mean deletion of data that POZA is obliged or entitled to continue storing under applicable law, in particular accounting and tax data and data necessary to establish, pursue or defend claims.
  • Accounts from which no Order has been placed and to which the Customer has not logged in for at least 6 months may be deleted after a prior reminder is sent to the e-mail address assigned to the Account.

VI. Rules for placing Orders

  • The condition for using the Store and placing an Order is reading and accepting the Terms and Conditions.
  • Orders may be placed:
    • via the form on the Store website – 24 hours a day, 7 days a week,
    • by e-mail: sklep@poza.pl,
    • by telephone: +48 583 260 768 – on business days from 9:00 a.m. to 3:00 p.m.
  • For Orders placed by telephone or e-mail, the Customer receives confirmation of the Order terms and the text of the Terms and Conditions on a durable medium, i.e. by e-mail, no later than at the time of confirmation that the Order has been accepted for processing, in accordance with Article 21 of the Polish Consumer Rights Act.
  • An Order may be placed:
    • after registering and logging into the Account, or
    • using the “Purchase without registration” function.
  • To place an Order, the Customer adds Products to the Cart, selects the color, size and quantity, provides the delivery address, telephone number and invoice details, if different from the delivery details, and then accepts the Terms and Conditions.
  • Orders placed on Saturdays, Sundays, public holidays and on business days after 12:00 p.m. are processed on the next business day.
  • Placing an Order in the Store results in a payment obligation on the part of the Customer.
  • After placing an Order using the form on the Store website, the Customer receives an automatic e-mail confirming the Order details.
  • When placing an Order by e-mail, the Customer provides the names of the Products, color, size, quantity, delivery address and invoice details, and declares that they accept the Terms and Conditions. The Store sends confirmation of acceptance of the Order and information about Product availability. Please do not provide any data in the e-mail other than data necessary to process the Order.
  • The Sales Agreement is concluded when the Store confirms acceptance of the Order.
  • To process the Order, it is necessary to provide true and up-to-date data. In case of doubts as to their accuracy, POZA may refuse to process the Order after first attempting to contact the Customer.

Payment methods

  • PayU – fast online transfers, BLIK, payment/credit cards.
  • Traditional bank transfer – to the Seller’s bank account; details are provided on the Store website and in the Order e-mail.
  • Payment on delivery / cash on delivery:
    • within Poland – to the InPost or DHL courier,
    • outside Poland – to the DHL courier, if this option is available for the given country and delivery method; the information is displayed in the Cart.
  • In the case of a traditional bank transfer, failure to receive the payment within 5 business days of placing the Order may result in cancellation of the Order.
  • Order processing begins:
    • in the case of payment on delivery – after the Store receives the Order,
    • in the case of traditional bank transfer – after the payment is credited to the POZA account,
    • in the case of PayU payment – after confirmation of successful payment is received.

Changes and cancellation of Orders

  • Until confirmation that the Order has been accepted for processing is sent, the Customer may change or cancel the Order by contacting the Store by e-mail or telephone.
  • Changes may concern in particular: cancellation of all or part of the Order, change of delivery address, change of invoice details.
  • In the event of cancellation of an Order paid in advance, the refund will be made without undue delay, no later than within 14 days from receipt of the cancellation, to the account from which the payment was made or by postal order if the Customer does not have a bank account.
  • If the analysis of a given Customer’s orders shows that the Customer repeatedly places numerous Orders and returns most or all Products, generating unjustified costs for the Store, POZA reserves the right to refuse to process further Orders from that Customer for a period of up to 12 months, of which the Customer will be informed by e-mail. Such refusal does not affect the Customer’s right to withdraw from already concluded agreements or rights arising from the non-conformity of goods with the agreement.

VII. Delivery

  • Ordered Products are delivered by courier companies such as InPost, DHL and other carriers indicated in the Cart, if available.
  • Delivery within Poland is free of charge, regardless of the Order value.
  • The cost of delivery outside Poland and the conditions of any free international delivery are displayed each time in the Cart, depending on the delivery country, carrier and Order value.
  • The delivery time includes the time required to prepare the Order for dispatch and the delivery time by the carrier.
  • In the event of withdrawal from the Sales Agreement by the Customer, the cost of returning the Product to the Store is borne by the Customer, regardless of the delivery country. This information constitutes fulfillment of the information obligation under Article 12(1)(10) of the Polish Consumer Rights Act.
  • Personal collection at the POZA registered office is not possible.

VIII. Complaints and returns

1. Withdrawal from the agreement / return

  • A Customer who is a Consumer or an Entrepreneur with consumer rights has the right to withdraw from the Sales Agreement without giving any reason:
    • within 14 days from receipt of the shipment – if the delivery address is located in Poland,
    • within 30 days from receipt of the shipment – if the delivery address is located outside Poland.
  • To meet the deadline, it is sufficient to send the withdrawal statement before the deadline expires.
  • The withdrawal statement may be sent by e-mail to sklep@poza.pl or attached in written form to the returned Product.
  • The Product should be sent to the following address:

  • For efficient processing of the return, please provide the Order number or attach proof of purchase, if the Customer has it.
  • A Product may be returned provided it is intact, unused, with the original tag/seal attached, and free from signs of use, dirt and foreign odors. The Product should be returned, if possible, in its original packaging, using a registered shipping method. The cost of return shipment is borne by the Customer, regardless of the delivery country.
  • The Store refunds the amount paid for the Product and – in the case of returning the entire Order – the original delivery costs up to the amount of the cheapest delivery method offered by the Store, within 14 days from receipt of the withdrawal statement. POZA may withhold the refund until it receives the Product or proof of its return shipment.
  • The refund is made using the same payment method used by the Customer, unless the Customer agrees to another refund method that does not involve any additional costs for them.
  • The right of withdrawal does not apply in the cases specified in Article 38 of the Polish Consumer Rights Act, in particular with regard to:
    • Products made according to the Consumer’s specifications or intended to meet their individualized needs,
    • Products in sealed packaging which cannot be returned after opening due to health protection or hygiene reasons,
    • Products which, after delivery, due to their nature, become inseparably connected with other items.

2. Non-conformity of goods with the agreement

  • POZA is obliged to deliver to the Customer a Product that conforms to the agreement. The rules of POZA’s liability towards the Consumer and Entrepreneur with consumer rights for non-conformity of goods with the agreement are regulated by Chapter 5a of the Polish Act of 30 May 2014 on Consumer Rights.
  • The Product conforms to the agreement if, in particular, its description, type, quantity, quality, completeness and functionality conform to the agreement, and in the case of clothing – also its size and workmanship.
  • POZA is liable for non-conformity of goods with the agreement existing at the time of delivery and revealed within 2 years from that time.
  • If the Product is non-conforming with the agreement, the Consumer may request its repair or replacement. POZA performs the repair or replacement within a reasonable time from the moment it is informed by the Consumer of the non-conformity, and without excessive inconvenience to the Consumer.
  • POZA may refuse to bring the goods into conformity with the agreement if repair and replacement are impossible or would require excessive costs.
  • If the Product is non-conforming with the agreement, the Consumer may submit a statement on price reduction or withdrawal from the agreement if:
    • POZA refused to bring the goods into conformity with the agreement,
    • POZA did not bring the goods into conformity with the agreement within a reasonable time or without excessive inconvenience to the Consumer,
    • the non-conformity of the goods with the agreement is significant enough to justify an immediate price reduction or withdrawal from the agreement,
    • it follows from POZA’s statement that it will not bring the goods into conformity with the agreement within a reasonable time.
  • The Consumer may not withdraw from the agreement if the non-conformity of the goods with the agreement is insignificant.
  • A complaint may be submitted by e-mail to sklep@poza.pl, by telephone at +48 583 260 768 or in writing to the Store address.
  • Before sending back the Product under complaint, we recommend contacting the Store to agree on the method of handing over the parcel. POZA may arrange a courier collection.
  • For efficient complaint processing, please provide the Order number or attach proof of purchase, if the Customer has it, and describe the Product’s non-conformity with the agreement and, if possible, attach photos.
  • POZA will respond to the complaint within 14 calendar days of receiving it. No response within this period means that the complaint is deemed justified.
  • In the case of an accepted complaint, the costs of delivery and return shipment of the Product are borne by POZA.
  • If the complaint is rejected, the Product will be returned to the Customer together with a written justification.
  • Please do not send parcels cash on delivery. In the case of an accepted complaint, POZA will reimburse the Customer for justified costs of sending the Product under complaint or will provide its own collection method.

IX. Newsletter

  • The Customer may subscribe to the Newsletter by entering their e-mail address in the appropriate form on the Store website and voluntarily consenting to receive commercial and marketing information electronically.
  • Consent to receive the Newsletter is voluntary and may be withdrawn at any time, in particular by clicking the unsubscribe link in the Newsletter content or by contacting the Store at sklep@poza.pl.
  • Withdrawal of consent does not affect the lawfulness of actions performed before its withdrawal.

X. Minimum technical requirements

  • A device with Internet access.
  • An up-to-date web browser, e.g. Chrome, Firefox, Opera, Safari, Edge.
  • An active e-mail account for registration and contact.
  • The Store uses the SSL protocol to secure data transmission.

XI. Out-of-court complaint handling and claim settlement methods

The Consumer has the right to use out-of-court complaint handling and claim settlement methods.

Detailed information is available from municipal and county consumer ombudsmen, the Trade Inspection and on the websites of the Polish Office of Competition and Consumer Protection:

The Consumer may use, among others, the assistance of a consumer ombudsman, mediation by the Trade Inspection or an arbitration court at the Trade Inspection.

The entity competent to conduct proceedings for out-of-court resolution of consumer disputes for POZA Zakład Krawiecki Bożena Pozauć is the Trade Inspection in Gdańsk (www.ihgd.pl).

The European Commission previously operated the ODR platform for online consumer dispute resolution. The ODR platform was closed on 20 July 2025 and is no longer available. For out-of-court dispute resolution, the Consumer may use, in particular, the assistance of the Trade Inspection or the consumer ombudsman competent for their place of residence.

XII. Final provisions

  • Personal data protection is carried out in accordance with the Privacy Policy and cookies information.
  • Polish law applies to Sales Agreements concluded in the Store. The agreement is concluded in Polish.
  • In matters not regulated by these Terms and Conditions, Polish law applies, in particular the Polish Civil Code and the Consumer Rights Act.
  • POZA reserves the right to amend the Terms and Conditions. Changes enter into force 7 days after their publication on the Store website and apply to Orders placed after that date. Customers with an Account will be informed of the change by e-mail.
  • A Customer who does not accept changes to the Terms and Conditions may request deletion of the Account at any time. Deletion of the Account does not affect the obligation to store data required by law.

Privacy Policy

We respect your right to privacy and care about the security of your personal data. We process it in accordance with applicable law, in particular the GDPR, i.e. Regulation (EU) 2016/679 of the European Parliament and of the Council.

§2. What data we process and for what purpose

We process only data necessary to provide services at a high level:

  • data provided when creating an Account and placing Orders: first name, surname, e-mail address, delivery address, invoice details, telephone number, payment data to the extent necessary to handle the transaction,
  • technical data related to the use of the website, such as IP address, device and browser data, cookies.

Main purposes and legal bases of processing:

  • Processing Orders and performing sales agreements – Article 6(1)(b) GDPR, necessity for the performance of the agreement.
  • Creating and managing the Account – Article 6(1)(b) GDPR.
  • Payment handling – Article 6(1)(b) and (f) GDPR, agreement and our legitimate interest in ensuring payment security.
  • Compliance with legal obligations, e.g. accounting and tax obligations – Article 6(1)(c) GDPR.
  • Contact by e-mail or telephone – Article 6(1)(b) or (f) GDPR.
  • Newsletter – based on your consent, Article 6(1)(a) GDPR.
  • Establishing, pursuing or defending claims – Article 6(1)(f) GDPR.
  • Traffic analysis and statistics, analytical cookies, e.g. Google Analytics – Article 6(1)(a) GDPR, user consent.
  • Marketing and remarketing, marketing cookies, e.g. Meta Pixel – Article 6(1)(a) GDPR, user consent.

When contacting us, please do not provide sensitive data, such as health data, which we do not require.

§3. Data storage period

  • Data related to the performance of the agreement is stored for the limitation period for claims arising from that agreement, extended by a maximum of one year in case a claim is raised shortly before the expiry of the basic limitation period.
  • Accounting and tax data is stored for the period required by law, e.g. accounting and tax regulations.
  • Data processed on the basis of legitimate interest is stored until that interest ceases to exist or an effective objection is raised.
  • Data processed on the basis of consent is stored until consent is withdrawn.

§4. Data recipients

Your data may be transferred to entities cooperating with us in operating the Store, in particular:

  • the company operating the Store software,
  • courier companies and delivery operators,
  • hosting and IT service providers,
  • the payment operator PayU,
  • the accounting office,
  • debt collection service providers and banks – if necessary,
  • Google LLC – in connection with the use of Google Analytics for website traffic analysis, only after obtaining your consent,
  • Meta Platforms Ireland Ltd – in connection with the use of Meta Pixel for remarketing and advertising effectiveness analysis, only after obtaining your consent,
  • eKomi Ltd. – in connection with the operation of the consumer review system, to the extent necessary to verify and publish reviews,
  • Zaufane.pl – in connection with the operation of the consumer review system, to the extent necessary to verify and publish reviews,
  • public authorities, if the obligation to disclose data results from law.

§5. Your rights

In connection with the processing of your data, you have, among others, the following rights:

  • the right of access to data and to receive a copy of it,
  • the right to rectify data,
  • the right to erase data (“right to be forgotten”) – in cases provided for by the GDPR,
  • the right to restrict processing,
  • the right to object to processing based on legitimate interest,
  • the right to data portability – in relation to data processed on the basis of an agreement or consent,
  • the right to lodge a complaint with the Polish data protection supervisory authority, UODO,
  • the right to withdraw consent at any time, without affecting the lawfulness of processing carried out before withdrawal.

To exercise your rights, please contact us using the details indicated in §1. We may request additional information to confirm your identity.

In certain situations, for example due to tax obligations, we may refuse to comply with your request if the law allows us to do so.

§6. Transfers of data to third countries

As a rule, we do not transfer your data outside the European Economic Area (“EEA”).

However, data may be transferred outside the EEA in connection with the use of some external providers, in particular Google and Meta. Such transfer takes place on the basis of appropriate mechanisms provided for by the GDPR, in particular an adequacy decision if the provider participates in the EU–US Data Privacy Framework, or standard contractual clauses approved by the European Commission.

§7. Automated decision-making

We do not make decisions concerning you in an automated manner, including profiling that produces legal effects.

§8. Cookies

Our website uses cookies in accordance with the Polish Telecommunications Law of 16 July 2004 and the Polish Electronic Communications Law of 12 March 2022, as well as in accordance with the GDPR. Cookies are small text files sent by the server and stored in the memory of your device, such as a computer or phone. On your next visit, the website may recognize your device.

Cookies may be read both by our system and by systems of external entities, such as Google LLC or Meta Platforms Ireland Ltd. Based on cookies alone, we are not able to identify a specific user without additional information.

We use the following categories of cookies:

  • Necessary cookies – required for the proper operation of the Store, in particular maintaining the session, Cart status and Account login. They are used on the basis of the Controller’s legitimate interest in ensuring the proper operation of the Store, Article 6(1)(f) GDPR, and do not require your consent.
  • Analytical cookies – enable analysis of website traffic and improvement of its operation, e.g. Google Analytics. They are used only after obtaining your consent.
  • Marketing cookies – used for advertising personalization and remarketing, e.g. Meta Pixel. They are used only after obtaining your consent.

By default, most browsers allow the use of cookies. You may change your browser settings at any time or use the consent management tool available on the Store website, in particular to block cookies or delete existing cookies.

Restricting the use of necessary cookies may affect some Store functions, such as remembering the Cart or logging in.

How to block cookies

§9. Consumer reviews

The Store provides a consumer review system through the platforms eKomi and Zaufane.pl. Published reviews come from Customers who made a purchase in the Store or had an actual shopping experience related to the Store. The authenticity of reviews is verified in accordance with the procedures used by the operators of these platforms.

The Store does not publish or commission false reviews, nor reviews motivated by incentives in a manner contrary to applicable law.
