Terms and Conditions of the POZA Online Store

I. General Provisions

The online store available at www.poza.pl (hereinafter: “Store”) is owned and operated by:

Definitions:

  • Store – the POZA online store located at www.poza.pl.
  • Client – any natural person with full legal capacity, as well as any legal person or organisational unit with legal capacity that uses the Store.
  • Consumer – a Client qualifying as a consumer under applicable EU law.
  • Terms – these Terms and Conditions.
  • Order – a declaration of intent submitted via the Store, by email or by phone, aimed at concluding a sales contract with POZA.
  • Account – an electronic service where Client details, order history and wishlist items are stored.
  • Wishlist – a feature enabling Clients to save products of interest.
  • Product – goods offered for sale in the Store.
  • Sales Contract – a contract concluded remotely between the Client and POZA.
  • Newsletter – a service consisting of commercial email communication.

By placing an Order or using the Store, the Client confirms that they have read, understood and accepted these Terms. Selecting the appropriate checkbox during checkout confirms acceptance of the Terms and acknowledgment of the Privacy Policy.

These Terms do not exclude or limit any rights granted to Consumers under mandatory law. In case of any inconsistency, mandatory provisions shall prevail.

II. Products and Prices

  • All Products offered in the Store are brand new and free from defects.
  • Product descriptions include details of the item’s characteristics, size options and pricing.
  • Product information (descriptions, prices, etc.) does not constitute an offer under civil law but is an invitation to enter into a contract.
  • Colours displayed on photos may differ from the actual Product due to screen settings.
  • The binding price is the price displayed at the time the Client submits the Order. All prices are expressed in Polish zloty (PLN) and include VAT.
  • Delivery costs are not included in the Product price unless otherwise stated. Total payable amounts are shown in the Cart.
  • POZA reserves the right to change prices, run or cancel promotions and sales. Such changes do not affect Orders placed before the change.

III. Client Obligations

  • Use the Store in accordance with the law, these Terms and good practice.
  • Refrain from providing unlawful content.
  • Do not interfere with the operation or security of the Store.

IV. Account

  • To create an Account, the Client must complete the registration form (name, surname, email address).
  • Additional data (delivery address, invoice details) may be provided at checkout.
  • Creating an Account is free of charge.
  • Login requires the Client’s email and password.
  • The Client receives a confirmation email after registering the Account. The electronic service is provided for an indefinite period.
  • The Client may request deletion of an Account from which no Orders have been placed.
  • POZA may immediately block or delete an Account if the Client:
    • violates the Terms or the law,
    • poses a security threat or disrupts the Store.
  • Accounts from which Orders have been placed cannot be deleted — they may only be blocked. Their data is retained for legally required periods.
  • Accounts without Orders, inactive for at least 6 months, may be deleted after email notification.

V. Orders and Payments

  • Placing an Order requires accepting these Terms.
  • Orders may be submitted:
  • Orders may be placed with or without Account registration (“guest checkout”).
  • The Client selects Products, their size/colour, quantity, enters delivery details, phone number, invoice details (if needed), then confirms acceptance of the Terms.
  • Orders placed after 12:00 or on weekends/holidays are processed on the next business day.
  • Submitting an Order constitutes an obligation to pay.

Payment Methods

  • PayU – online card payments, BLIK, fast transfers.
  • Bank transfer – to the POZA bank account.
  • Cash on delivery:
    • in Poland – InPost or DHL courier,
    • internationally – DHL only (if available at checkout).
  • If bank transfer payment is not received within 5 business days, the Order may be cancelled.
  • Order processing begins:
    • for cash-on-delivery – when the Order is accepted,
    • for bank transfers – upon receipt of funds,
    • for PayU payments – once the payment is confirmed.

Changing or Cancelling an Order

  • Before the Store confirms the Order for processing, the Client may modify or cancel it by contacting us via email or phone.
  • Refunds for cancelled prepaid Orders are issued within 14 business days.
  • If analysis shows that a Client repeatedly orders and returns goods in an abusive or excessive manner, POZA reserves the right to refuse to fulfil future Orders from that Client for up to 12 months. The Client will be notified by email.

VI. Delivery

  • Products are delivered via InPost, DHL and other available carriers.
  • Shipping within Poland is always free.
  • International delivery costs and thresholds for free delivery (if applicable) are displayed in the Cart and depend on the country, carrier and Order value.
  • Personal collection is not available.

VII. Withdrawal and Returns

1. Withdrawal (Returns)

  • Consumers may withdraw from the Sales Contract within 30 days from receiving the Product — without giving any reason.
  • To withdraw, the Client must send a return statement and return the Product to:
    POZA – Sklep, ul. Kuszników 7, 80-175 Gdańsk, Poland.
  • Returned Products must be unused, undamaged, with original tags, and free of odours or signs of use.
  • Return shipping costs are borne by the Client.
  • Refunds are issued within 14 days after receipt of the returned Product or proof of shipment.
  • Exceptions to withdrawal apply to:
    • custom or personalised items,
    • sealed hygiene-sensitive items after opening,
    • items inseparably mixed with other goods.

VIII. Newsletter

  • The Client may subscribe to the Newsletter by entering their email address in the designated field.
  • Consent may be withdrawn at any time, including via the unsubscribe link available in every email.

IX. Minimum Technical Requirements

  • A device with Internet access (computer, smartphone or tablet).
  • An up-to-date web browser (Chrome, Firefox, Safari, Edge, Opera).
  • An active email address.
  • The Store uses SSL encryption to ensure secure data transmission.

X. Out-of-Court Dispute Resolution

Consumers are entitled to use out-of-court procedures for handling complaints and pursuing claims as provided by Polish and EU law.

Information regarding available methods is provided by:

  • local consumer ombudsmen,
  • the Trade Inspection (Inspekcja Handlowa),
  • the Office of Competition and Consumer Protection (UOKiK).

XI. Final Provisions

  • Personal data is processed in accordance with the Privacy Policy.
  • Sales Contracts are governed by the laws of Poland.
  • In matters not regulated in these Terms, provisions of the Polish Civil Code and other mandatory legislation apply.
  • POZA reserves the right to amend the Terms at any time. Updated Terms become effective 7 days after publication and apply to Orders placed thereafter.

We respect your privacy and are committed to protecting your personal data in accordance with applicable European and Polish law (GDPR). We use physical, organisational and technical safeguards to ensure data security.

2. Scope of Processed Data

We limit data collection to what is necessary to provide our services. We process:

  • name and surname,
  • email address,
  • delivery address,
  • invoice details (incl. tax identifiers),
  • phone number,
  • bank account / payment details (for non-COD payments),
  • IP address and technical data collected during site visits,
  • cookie files.

Legal Bases:

  • performance of a contract or steps prior to entering into a contract – GDPR Art. 6(1)(b);
  • your consent (e.g., Newsletter) – GDPR Art. 6(1)(a);
  • legal obligations (accounting, taxation) – GDPR Art. 6(1)(c);
  • legitimate interests of POZA, including protection against claims – GDPR Art. 6(1)(f).

When contacting us by email or phone, please do not send unnecessary personal data (especially sensitive data).

3. Data Retention Periods

  • Contract-related data is stored until the end of the statutory limitation period for claims, plus up to one additional year.
  • Accounting data is stored for periods required by law.
  • Data processed based on consent is stored until consent is withdrawn.
  • Data processed on legitimate interest is retained until the interest ceases or a valid objection is lodged.

4. Data Recipients

We may share data with:

  • service providers operating the Store platform,
  • IT and hosting providers,
  • couriers (InPost, DHL, others),
  • payment processor PayU,
  • banking institutions,
  • accounting and administrative service providers,
  • debt collection companies (when lawful),
  • public authorities where required by law.

5. Your Rights

You have the right to:

  • access your data and obtain a copy,
  • rectify incorrect data,
  • request deletion (“right to be forgotten”),
  • request restriction of processing,
  • object to processing based on legitimate interests,
  • data portability,
  • withdraw consent at any time,
  • lodge a complaint with a supervisory authority.

6. Transfer of Data Outside the EEA

We store and process data within the European Economic Area. When partners such as Meta or Google process data outside the EEA, it is safeguarded with Standard Contractual Clauses (SCC).

7. Automated Decision-Making

We do not engage in automated decision-making or profiling.

8. Cookies

We use cookies for:

  • maintaining your session and login status,
  • supporting the shopping cart and checkout,
  • analytics via Google Analytics,
  • marketing tools (Facebook/Meta).
